The rules

Main residence in Nice: let up to 120 days a year without authorisation

This is the only way to let by the night without a change of use: letting the home you actually live in at least eight months a year, within 120 days a year. Nice voted 90 days in 2025; the Métropole now applies 120 days.

What counts as a main residence

Under French law, it is the home occupied at least eight months a year by the owner or their spouse, except for professional obligation, health reasons or force majeure. A property you do not live in is not your main residence.

What is allowed

  • Letting as a furnished holiday rental up to 120 days a year, without a change of use.
  • Letting a room in your home.
  • Combining with a mobility lease when you leave for several months for an eligible reason.
