Compensation in Nice: getting a permanent authorisation

Compensation is the only route to a permanent change-of-use authorisation, attached to the property and passed on when you sell. It is mandatory from the first flat for companies whose main activity is letting property, and for individuals beyond their temporary authorisation.

The principle

You take a dwelling out of the housing stock to make it a holiday rental; in exchange, you turn premises that were not housing into a dwelling. The Métropole states that these premises can be in any district of Nice, must not be residential, and must be at least as large as the holiday rental, with a 5% tolerance.

Who must compensate

  • A legal entity whose main activity is letting property professionally or commercially, from the first flat.
  • An individual who has already used their temporary authorisation, or wants to let several flats.
  • Any owner who wants an authorisation that transfers to the buyer on resale.

Two ways to compensate

Convert premises you own or buy (office, shop, business premises) into housing, with the required planning permissions. Or buy a “commercialité” from an owner who carries out such a conversion.
