Change-of-use application in Nice: the process, step by step

Since 1 September 2026, letting a second home in Nice as a furnished holiday rental requires a change-of-use authorisation from the Métropole Nice Côte d’Azur, under the regulation adopted on 22 June 2026. Here is the full path, from eligibility to your first listing.

1. Check that you are eligible

The temporary authorisation is reserved for private individuals and assimilated legal entities, one per owner and tax household, for up to 5 years, non-renewable. A legal entity whose main activity is letting property must use compensation from the first flat.

If the property is your main residence and you let it 120 days a year or fewer, no authorisation is needed: see the 120-day rule. The checker gives you the answer in a minute.

2. Locate the property: quota zone or not

Four zones covering 39 IRIS are capped in 2026: Vieux-Nice (47 authorisations), Riquier – Port – Mont-Boron (204), city centre (324) and West (116), 691 in total. In these zones, first applications are filed within a limited window and ranked by arrival of complete files. Elsewhere, you can apply all year with no cap.

3. Gather the documents

An incomplete file does not hold a place in the queue. The usual documents:

  • the application form;
  • the title deed or a notary’s certificate;
  • an ID document for each owner (a passport is fine);
  • an energy performance certificate (DPE) under 10 years old, made after 30 June 2021, rated A to E;
  • a power of attorney if someone files on your behalf;
  • for a company: up-to-date articles of association;
  • a sworn statement on the co-ownership rules.

4. File online

Applications are filed online only, on the Métropole platform (changementdusage.fr/nice), in French. In quota zones the 2026 window runs from 1 September to 21 December 2026 according to the public notice (the Métropole web pages say 31 December): filing early matters. One file per owner, for one property, across all zones. An incomplete file in a quota zone is rejected with no chance to complete it, and there is no waiting list. Outside quota zones you can also file on paper or by appointment, never by email.

5. Review and decision

The Métropole has 4 months from the acknowledgement of receipt; after that, silence means refusal. The authorisation is personal, cannot be sold and cannot be moved to another property. If it is refused, remedies exist: see refusal and appeal.

6. Register the rental and start letting

Once authorised, the property must be declared to obtain a registration number, shown on every listing. Also check the co-ownership rules, the tourist tax and taxation.
